I acknowledge that images/videos created by The Launching House remain copyright and property of The Launching House. Images/videos may not be edited or altered by CLIENT, including via filters or through apps, and digital files are released to the CLIENT for business use. Written permission from The Launching House must be obtained prior to any sales, publications or contest entries made with the images/videos. Sharing the images on social media should include a credit to The Launching House (Facebook and Instagram/@thelaunchinghouse, or website www.thelaunchinghouse.com) .

Retainers may be taken to hold the time and date of the session. As The Launching House blocks off that session spot time exclusively for CLIENT, I understand that retainers are not returned in the event of a cancellation. Sessions are also not guaranteed until the retainer is paid. In the event of cancellation, or complications regarding your session, please don’t hesitate to get in touch with The Launching House to work out a solution.

I understand that 50% payment is required at the start of or prior to the session. Complete payment must be made before final product is sent to CLIENT, and late payments will be billed at $50/day. Sneak peeks will not be shown online until full payment has been made, retainers will be applied to the unpaid session fee, and all files from unpaid sessions will be deleted after 30 days, unedited. Additional fees may apply for: more than 2 pets, extensive edits, added people, travel and returned payments (bounced cheques, etc).

I grant unrestricted, irrevocable permission to The Launching House to use, display, publish, print and exhibit images and/or video taken of my business with proper credit given. Permission may include, but is not is limited to, the Internet (including social media outlets such as, but not restricted to: Facebook, Instagram, Pinterest, Flickr). Permission will be asked of the CLIENT before entering photography competitions and art gallery exhibitions. I release all claims to any profits that may arise from these endeavours, and hereby release The Launching House and its legal representatives and assigns from all claims and liability in relation to said photographs/video/works.

I understand that requested reshoots due to factors outside of The Launching House’s control (including but not limited to: tardiness, appearance, outfits, behaviour) will be billed at regular photography rates as a new session. Late arrivals will not extend the session time. For this reason, The Launching House is not responsible for the limited amount of gallery images or video length produced via shortened session times.

The Launching House takes the utmost care with all files, but in the event of loss or damage outside of it’s control (including but not limited to: card / camera / hard drive malfunction, fire, theft), I agree The Launching House will only be liable for refunding the price of the overall session or providing a reshoot. 

Once images are delivered to the client, images/videos are archived. A $100 unarchiving fee will be charged for re-delivering files after 30 days, per retrieval. Images/videos are archived for a limited amount of time. I acknowledge that it is CLIENT's responsibility to back up all files, and The Launching House is not responsible for files after they have been downloaded by client/delivered. (Online backups like BackBlaze.com or Dropbox, as well as USB sticks, or external hard-drives are recommended.)

Editing includes, but is not limited to, image/video processing for tone, colour, exposure, sharpness and grain. Extensive edits may be available at an additional charge, dependent upon request. Photo shoot editing can take up to 6-8 weeks – in the event that editing should take longer, The Launching House will be in touch as soon as possible. Social media videos (Instagram/Facebook reels, TikTok videos) will be ready in 2-5 business days, in the event that editing should take longer, The Launching House will be in touch as soon as possible. Promotional videos will be ready in 3-5 weeks, in the event that editing should take longer, The Launching House will be in touch as soon as possible. Rush orders may be available for additional fees. I also understand once photos/videos are edited and complete, The Launching House is not required to make further editing changes, and RAW (unedited) photos/video will not be provided.

I acknowledge that it is CLIENT’s responsibility to obtain media release forms from models being photographer/filmed. The Launching House takes no responsibility for providing model release forms for CLIENT’s models. Model release forms can be purchased from The Launching House for $5 for the indefinite use of CLIENT.

The Photographer and Videographer (The Launching House) and licensees or assignees may have unrestricted use of these for whatever purpose, including advertising, with any retouching or alteration without restriction.

I have read this contract form carefully and fully understand its meanings and implications.
